The use of AI in education is spreading rapidly, but 0% of schools consider themselves to be fully prepared, according to results from the 2025 Association of School Business Administrators (ASBA) AI Preparedness Survey.

  • 83% have not discussed AI with parents

While Australia has certain frameworks and guidelines in place, the Australian government has yet to introduce specific legislation governing AI in education.

Meanwhile, international regulators have acted quickly, and their actions are strong indicators of what’s coming next for Australia.

European Union: Education is a ‘High Risk’ sector

The new EU AI Act (entered into force mid-2024) classifies AI systems used in education – like grading algorithms, admissions tools, and exam proctoring – as ‘high risk’. This means any school using these tools must ensure:

  • Transparent decision-making
  • Independent auditability and record keeping
  • Human oversight
  • Comprehensive risk assessments

From February 2025, EU schools are also expected to provide AI literacy training for all educators, making teacher preparedness a legal requirement.

United States: Data protection and parental consent

In the US, AI usage in schools is governed under federal student privacy laws like the Family Educational Rights and Privacy Act (FERPA) and the Children’s Online Privacy Protection Act (COPPA). These require strict parental consent before tools collect data from children under 13. Many states have also introduced their own AI ethics frameworks and guidelines for classroom use.

International developments like these point to a clear trend: governance is no longer optional. It’s fast becoming a compliance issue, and Australian schools should expect similar expectations to arrive soon.

Steps for responsible AI use in Australian schools

  • Communicate openly. Keep parents and students informed about what’s being used and why.

With the right planning and strict governance, AI doesn’t have to be a risk. It can be a powerful tool that enhances teaching and learning while ensuring it supports student wellbeing and values.
